What is Labour Market Testing (LMT)?

Labour Market Testing (LMT) is a mandatory requirement for most Subclass 482, 494 and 186 visa nominations. Before sponsoring an overseas worker, Australian employers must demonstrate genuine efforts to find a suitable Australian citizen or permanent resident first.

LMT requires:

  • Advertising on at least two appropriate platforms
  • Running the advertisement for a minimum of 28 days
  • Keeping records of all applicants and outcomes
  • Providing a formal evidence report with the nomination

Failure to meet LMT requirements is one of the most common causes of nomination refusal. Getting it right the first time is critical.

Who Needs Labour Market Testing?

LMT is required for:

  • Employers sponsoring under Subclass 482 (TSS)
  • Employers sponsoring under Subclass 494 (SSESR)
  • Employers nominating under Subclass 186 (ENS) Direct Entry stream
  • Migration agents managing nominations on behalf of employers

LMT is NOT required if:

  • The nominee is a citizen of a country with a Free Trade Agreement with Australia — including USA, UK, China, Japan and South Korea
  • The position is on the International Trade Obligations (ITO) list
  • The nominee is being sponsored by the same employer under an existing visa

Our Process — Five Gates Before We Start

We follow a structured intake process. Every engagement passes through five checkpoints before document drafting begins.

Gate 1 — Enquiry & Scope Confirmation: You send us the matter details. Within one business day, we confirm the service applies, provide a fixed-fee quote, and outline what we need from you.

Gate 2 — Sponsor & Role Verification: We review the sponsor’s business details, ABN, and the nominated role. The sponsor confirms in writing that the position is genuine, that the stated salary will be paid, and that the role exists independently of any migration outcome. If a nominee is identified at this stage, we review their CV against the documented role and ANZSCO duties. If there is a material mismatch, we raise it with you before proceeding.

Gate 3 — Brief Completion: You complete a structured brief covering the position details, business operations, salary, and nominee information. This takes approximately 10 minutes.

Gate 4 — Payment & Engagement: Once Gates 1–3 are cleared, we issue a tax invoice to the engaging party (sponsor or referring agent’s practice). Work commences upon payment.

Gate 5 — Draft Review & Sign-Off: We deliver a first draft for your review. Two revision rounds are included. The final version is released once you confirm accuracy. If at any point during drafting we identify information that appears inconsistent or raises integrity concerns, we will pause and discuss with you before continuing.

Payment — Who Pays

All fees are quoted in Australian dollars, inclusive of GST. Payment is due in full before work commences. We accept bank transfer, Visa, Mastercard, and American Express via Stripe. A tax invoice is issued upon payment.

Important: Under Migration Regulation 2.87, fees for services related to a visa nomination must not be paid by the visa applicant (nominee), either directly or indirectly. All fees for this service must be paid by the sponsoring business entity or the referring agent’s practice. We do not accept payment from nominees for sponsorship or nomination document services. This is not our policy — it is Commonwealth law, and we treat compliance as non-negotiable.

Termination and Refund

Either party may terminate this engagement at any time by written notice (email is sufficient).

  • Before drafting begins: Full refund of fees paid.
  • After drafting has commenced: Proportional refund based on work not yet completed. We will provide a written summary of work done and the refund amount.
  • Integrity concerns: If at any stage we form a reasonable belief that the information provided is materially inaccurate, that the position may not be genuine, or that continuing the engagement may result in a misleading submission to the Department, we reserve the right to suspend or terminate the engagement. A proportional refund will be provided and draft documents will be withheld.

Do I need all four documents?

Not necessarily. Some agents prepare their own contracts or GPS and only need the LMT or salary analysis. You can engage us for individual documents or the full package.

Can I use the LMT service if I haven’t identified a nominee yet?

Yes. The LMT campaign tests the local labour market — it does not require a nominee to be identified at the start. However, if a nominee is identified before or during the campaign, we will review their CV against the advertised role at Gate 2.

What if a suitable Australian applicant responds to the LMT ad?

That is the LMT working as designed. We log all applicants and forward them to the sponsor for genuine assessment. If the sponsor wishes to hire an Australian applicant, the nomination for the overseas worker may not proceed.

How do you handle the ANZSCO duty mapping?

We map every standard ANZSCO duty for the nominated occupation code to the specific duties in the position. This is the section case officers scrutinise most closely, and we treat it accordingly.

What if the salary is below CSIT?

We will raise this at Gate 1. If the proposed salary does not meet the applicable threshold, we cannot prepare compliant documents. We will advise on the minimum salary required.

How recently must the LMT ads have run?

The Department requires LMT ads to have been live within 4 months prior to nomination lodgement. We time campaigns to ensure your LMT evidence is current at the time the nomination is lodged.

Is LMT mandatory for all sponsorship nominations?

LMT is mandatory for most Subclass 482, 494 and 186 nominations. Exemptions apply for citizens of certain Free Trade Agreement countries and positions on the ITO list. We can confirm whether LMT applies to your specific nomination during the initial consultation.

Can migration agents use this service for their clients?
